These Terms of Service (“Terms”) govern your use of grailguns.com (the “Site”) and any purchase you make through it. By using the Site or placing an order you agree to these Terms. If you do not agree, do not use the Site.
Grail Guns is a federally licensed firearms dealer located in Alabama. We sell firearms, serialized firearm components, and related accessories and apparel.
You must be at least 18 years old to use the Site and to purchase accessories or apparel, and at least 21 years old to purchase a handgun, handgun frame or receiver, or any serialized handgun component. By placing an order you confirm that you meet the age requirement and that you are legally eligible to purchase and possess the item under federal, state and local law.
Every firearm, frame, receiver, build kit or other serialized item sold through the Site ships only to a Federal Firearms Licensee (FFL) of your choosing. We do not ship these items to individuals.
At checkout you provide the name, city and phone number of the receiving dealer. Before we ship, we contact that dealer to confirm they will accept the transfer and obtain a copy of their license. If the dealer declines the transfer or does not respond within 10 business days, we will contact you for an alternate dealer. If no dealer can be arranged, we will cancel the order and refund the purchase price less any non-refundable portion described in Section 5.
The receiving dealer completes the ATF Form 4473 and background check and may charge their own transfer fee. That fee is between you and the dealer and is not included in our prices or shipping charges. If you do not pass the background check or otherwise cannot complete the transfer, the item is returned to us and the order is treated under Section 5.
You are responsible for knowing whether an item is legal to own where you live. We reserve the right to cancel any order we believe cannot lawfully be completed.
Prices are in US dollars and may change without notice. Most items we sell are one-of-a-kind or held in very limited quantity. A product shown as “In Stock” is available at the time the page was loaded; it may sell before your order is accepted. Your order is an offer to buy; it is accepted when we ship the item or, for pre-orders, when we confirm your allocation in writing.
If an item is listed at an incorrect price or with incorrect information, we may cancel the order and refund any amount paid, even after the order is confirmed.
Items marked “Pre-Order” or “Incoming” are not in our possession. Estimated arrival dates are estimates supplied by the manufacturer and are not guaranteed.
Pre-orders require a non-refundable deposit of 50% at the time of purchase. We will contact you for the balance when the item arrives, and the item ships to your FFL once the balance is paid. If the balance is not paid within 14 days of our notice, the item is released for sale and the deposit is forfeited. If the manufacturer cancels the item, the deposit is refunded in full.
Our Returns and Exchanges policy is part of these Terms. In short: all sales of firearms and serialized items are final. A refund is possible only while the item is still at the receiving dealer and has not been transferred into your name; once the transfer is complete, no return or refund is available. Cancellation of an order before shipment, a declined transfer, or a failed background check is refunded less any shipping already incurred. Accessories and apparel may be returned under the conditions in the Returns and Exchanges policy.
Firearms and serialized items ship by 2-day air, adult signature required, to the receiving FFL. Shipping for these items is $100 per order. Accessories and apparel ship for $9.99 (small items) or $19.99 (larger items, as marked on the product page). Each order carries one shipping charge, at the highest rate of the items in it. We ship to the United States only and do not ship to any address where the item is prohibited. Title and risk of loss pass to you when the carrier accepts the package; we will assist with carrier claims for loss or damage in transit.
Payments are processed through our merchant services provider, Payroc, using the Authorize.net payment gateway. Your card details are encrypted and sent directly to the gateway from the checkout form and are never stored on our servers. By submitting payment you authorize the charge for the order total shown at checkout. We may hold or cancel orders flagged for fraud review.
The VIP program is by invitation. Submitting the VIP interest form does not create a membership or any obligation on our part. Membership terms will be provided to accepted members separately.
If you create an account you are responsible for keeping your password confidential and for activity under your account. You agree not to use the Site to make a straw purchase, to misrepresent your identity or eligibility, or to interfere with the operation of the Site.
The Site’s content, including the Grail Guns name and logo, photographs and product descriptions, belongs to Grail Guns or its licensors and may not be reproduced without permission. Manufacturer names and marks belong to their respective owners.
Firearms are inherently dangerous. You are responsible for safe handling, storage and use, and for reading the manufacturer’s manual. Except as required by law, the Site and the products are provided “as is”; manufacturer warranties, where offered, are provided by the manufacturer and not by Grail Guns. To the fullest extent permitted by law, Grail Guns is not liable for indirect, incidental or consequential damages, and our total liability for any order is limited to the amount you paid for it.
These Terms are governed by the laws of the State of Alabama. Any dispute arising from these Terms or an order will be brought in the state or federal courts located in the State of Alabama, and you consent to their jurisdiction.
We may update these Terms at any time by posting a revised version with a new effective date. Orders are governed by the Terms in effect when the order is placed.
